The Delaware Affidavit of Mailing Guardianship is a court form used in the state of Delaware in probate proceedings, to document that a guardian has properly notified all parties of a guardianship petition. The Delaware Affidavit of Mailing Guardianship is used in guardianship proceedings of minors, incapacitated adults, and of deceased persons. The affidavit is signed by the guardian, and must include the names and addresses of all parties who were notified, the date of service, and the method of service. There are two types of Delaware Affidavit of Mailing Guardianship: one for the service of summons and one for the service of notice. The service of summons affidavit is used when the guardian is serving a summons to a party related to the guardianship, and the service of notice affidavit is used when the guardian is serving notice to a party related to the guardianship. Both affidavit forms must be notarized and filed with the court.
