What is mediation? Mediation is one of the most commonly used methods of alternative dispute resolution (ADR). In mediation, an independent and neutral advisor works with all parties to allow them to reach a mutually acceptable agreement or solution without taking the matter to court.

Colorado Revised Statute § 13-22-307 protects the confidentiality of information disclosed in mediations unless all parties consent otherwise, with the exception of a few extreme circumstances. However, mediation Page 4 agreements are legally binding, admissible in court and may be enforced by a court.

Mediation is generally voluntary, although on occasion a judge will order parties to engage in ADR. Our mediators can facilitate an ADR process in any type of dispute, even if the disagreement involves a case that is not pending at the Office of Administrative Courts.

Colorado statute does not require parties in a divorce case to attend mediation. However, many of the counties throughout the Denver metropolitan area do. For example, in a divorce in Douglas County or Arapahoe County, mediation will be required at least once, and sometimes twice.
