Interrogatories allow the parties to ask who, what, when, where and why questions, making them a good method for obtaining new information in a case. There are two types of interrogatories: form interrogatories and special interrogatories.

NUMBER AND SCOPE OF INTERROGATORIES. Rule 33(a), Federal Rules of Civil Procedure, restricts to 25 (including all discrete subparts) the number of interrogatories a party may serve on any other party.

Except as provided in these rules, a party shall not serve upon any other party more than forty (40) interrogatories, which may be any combination of uniform or non-uniform interrogatories. Any uniform interrogatory and its subparts shall be counted as one interrogatory.

(b) Except as provided in Section 2030.070, no party shall, as a matter of right, propound to any other party more than 35 specially prepared interrogatories. If the initial set of interrogatories does not exhaust this limit, the balance may be propounded in subsequent sets.

What types of questions can I ask in interrogatories? Questions about the other party's position or arguments in the case. Questions about the facts of the case. Questions about the other party's knowledge or understanding of relevant events or circumstances. Questions about the other party's witnesses or experts.

You may send up to 25 interrogatories to each party. You do not have to send them all at once. If this is not the first set of interrogatories you are sending to this party, renumber the interrogatories, starting with the number you left off on last time. Review, number the pages and sign.

You can use interrogatories to find out facts about a case but they cannot be used for questions that draw a legal conclusion.

?The Justice Court Rules of Civil Procedure allow a party to send up to five (5) interrogatories to another party, unless the party asks the court for permission to serve more and the court gives permission because the party showed good cause for serving more.
