Alaska Request to Exclude Case from Court view under Admin R 40(a) or AS 22.35.030 is a process by which certain Alaska court records can be excluded from public access on Court view, the Alaska Court System's online court records database. This process allows individuals to request that their court records be excluded from public view and only made available to authorized individuals. There are two types of Alaska Request to Exclude Case from Court view under Admin R 40(a) or AS 22.35.030: (1) Exclusion of Criminal Cases, and (2) Exclusion of Civil Cases. Exclusion of Criminal Cases allows individuals to request to have their criminal case records excluded from Court view. This includes cases involving misdemeanors, felonies, juvenile offenses, and other offenses. To be eligible for exclusion, the individual must have been granted a dismissal or discharge on the charges, or the charges must have been dismissed or discharged at least three years prior to the request. Exclusion of Civil Cases allows individuals to request to have their civil case records excluded from Court view. This includes cases involving small claims, contract disputes, landlord/tenant disputes, and other civil matters. To be eligible for exclusion, the individual must have obtained a final judgment in their favor, or the case must have been dismissed or discharged at least three years prior to the request. In both cases, the individual must submit an affidavit or sworn statement attesting that the charges have been dismissed or discharged, or that the case was decided in their favor. The request must be reviewed and approved by the presiding judge before the records can be excluded from Court view.
