ATF's National Firearms Act (NFA) Division is the only federal authority permitted to regulate firearms covered by the National Firearms Act. The NFA Division processes all applications to make, export, transport and register NFA firearms and destructive devices.
National Firearms Registration and Transfer Record (NFRTR). Records contain information for the registration and transfer of firearms, and information concerning the status of weapons.
Firearms not regulated by the NFA are referred to as “non-NFA firearms”. A non-NFA firearm would be illegal only if it is banned by a particular state. Under the NFA, states may restrict ownership beyond the restrictions imposed by the NFA, subject to the protections of the Second Amendment of the U.S. Constitution.
Section 9.1 Definition of “transfer.” The term “transfer” is broadly defined by the NFA to include “selling, assigning, pledging, leasing, loaning, giving away, or otherwise disposing of” an NFA firearm. 165. The lawful transfer of an NFA firearm generally requires the filing of an appropriate transfer.
