Who is eligible for special education? Under federal and state law, children with disabilities from birth through the end of the school year in which they turn age 21 may be eligible for special education and related services.
Eligibility for special education requires that the child's disability have an “educational impact.” If the team determines that the child needs special education supports and services, a draft IEP must be written and discussed during a team meeting within 30 days.
Schools must provide parents a copy of any “assessment, report, data chart, draft IEP or any other document that the team plans to discuss at least 5 business days before the scheduled meeting.” This law does NOT apply to the development and review of an Individualized Family Service Plan (IFSP).
