To legally inhabit and utilize any property, a Use and Occupancy Permit must be obtained. Every Use and Occupancy Permit is issued to a specific person or corporate entity for a specific allowable use at a specified location.
A Use & Occupancy Certificate is required for the space to be used prior to opening any business in Montgomery County. The purpose of this certificate is to document that the use is permitted, and that all applicable safety code and health code requirements have been met.

A final building inspection is required before a Certificate of Occupancy is issued. A Certificate of Occupancy will be granted on all new construction after the final building inspection has passed and a final survey is submitted to the Building Department.
