FAQ

An assignment is a full transfer of the lease between the tenant and the assignee. Therefore, since the tenant no longer has any ownership interest in the property, there is no longer any relationship between the landlord and the tenant as far as the property ownership is concerned.

This will be done using a Land Registry form known as a TR1. If the lease is for less than 7 years, then the lease can be assigned by using a deed of assignment. Both these documents have the same effect and will generally be executed by both you as the current tenant and the assignee.

To grow or react to market conditions your business may need to quickly leave its current premises. If your business rents the premises but there is still time left to run on the lease, what can you do? A common solution is to transfer your lease to someone else. This process is called 'assigning a lease'.

An assignment transfers one party's interest and obligations under a lease to another party. During these tenant transfers, the new tenant takes on the lease responsibilities, including paying rent and property maintenance of the leased premises, and the original tenant is released from most of their duties.

Standard Notice Periods for Ending a Lease as a Tenant Month-to Month Leases – Typically, a month-to-month lease requires 30-days' notice from the tenant. However, some leases may stipulate up to 60-days' notice. Annual Leases – A standard 12-month lease usually requires 90 days' notice.

If a landlord does not want to renew a tenant's lease, the landlord must provide a 60-day notice to vacate. This requirement applied to month-to-month leases, long term leases, multifamily and/or single family rentals. The landlord is not required to state a reason for the notice.

At the end of a long-term lease, if the landlord does not want to renew a tenant's lease, they must give the tenant sixty days' written notice to vacate in both single family and multifamily properties. Remember, tenants are still bound by the provisions of the lease, even though it has expired.

Weekly Leases - One week of notice. Monthly Leases - One month of notice. Yearly Leases - Three months of notice. If the landlord is working with a farm tenancy, the period is extended to six months of notice.

In Maryland, landlords must provide 15 days written notice before lease expiration with automatic renewal. If they fail to provide notice, the lease reverts to month-to-month.

Negotiating a commercial lease can take anywhere from one day to a year or more. It all comes down to how close the parties are in terms of expectations at the beginning. Additionally, if neither party is willing to give much leeway, the process can take time. However, the average length is about three to nine months.
