Texas has no blanket restrictions on short-term rentals. Prohibitions on such use must come from the HOA or the local municipality. Most restrictions on short-term rentals are stated in the HOA's declaration. The declaration is a contract to which all homeowners are parties.
Add or edit house rules Tap Listings and select the listing you want to edit. Under Listing editor, tap Arrival guide. Tap House rules and make your changes. Tap Save.
How to apply a rule set? Once created, and when selecting a date, you will be able to select this rule in the channel rule set dropdown. After any change, clicking on "Save changes" will still be needed. Those changes will then be reflected on Airbnb (no need to manually export the listing).
If you use professional hosting tools you can create and edit rule-sets on a single listing calendar or on your multi-calendar.
If you don't follow the rules set out in a listing the host can contact Airbnb to terminate your booking. Your request seems like a reasonable one but we don't know how reasonable your potential host will be. Best thing to do is contact them to clarify before booking.
The best way to strategize on short-term rental restrictions is to speak to a board member. At the same time, you can consult the CC&Rs' (Covenants, conditions, and restrictions) advice. Knowing the potential risks of getting around HOA's restrictions is important. And we highly recommend doing it the legal way.
How to add and edit house rules on Airbnb Head to the Airbnb dashboard and click on 'Menu' > 'Listings'. Click on 'Policies and rules' > 'House rules' on the side bar. Click the tick or cross symbols against each of the preset rules, and add any important information for each.
The short-term rental regulations in San Antonio, Texas require all short-term rentals located within the city limits to obtain a Short Term Rental permit to operate legally. These permits can be obtained through the City's Development Services Department.
The court ruled that using a property as a short-term rental did not violate HOA rules unless the rules specifically stated no STRs were allowed. Therefore, HOAs could not cite general clauses, such as no businesses permitted, to prohibit STRs. Instead, the HOA rules must specifically prohibit short term rentals.
In Texas, the laws for short term rentals are crafted at the city level, with no specific state limitations on operations. Hosts are required to register with the Texas Comptroller's Office for state hotel occupancy tax collection but do not need a state license for running a vacation rental.
