Description

There are various types of attorney fee arrangements such as time based, fixed, or contingent. Time based means a fee that is determined by the amount of time involved, such as so much per hour, day or week. Fixed means a fee that is based on an agreed amount, regardless of the time or effort involved or the result obtained. Contingent means a certain agreed percentage or amount that is payable only upon attaining a recovery, regardless of the time or effort involved.

With a contingent fee arrangement, the lawyer receives no fee unless money is recovered for the client. Upon recovery, the lawyer is paid an agreed-upon percentage, usually ranging from an amount equal to 25 to 50 percent of the amount recovered. A written fee agreement should specify the costs and expenses to be deducted and whether such costs and expenses are to be deducted before or after the contingent fee is calculated. Contingent fee agreements are generally not permitted for criminal cases or domestic relations matters.

Even if there is no recovery, however, the client is still responsible for court costs (filing fees, subpoena fees, etc.) and related expenses, such as telephone charges, investigators' fees, medical reports, and other costs.

Credit repair typically refers to disputing inaccurate credit report information, either yourself or by hiring a credit repair company. Another form of credit repair is to address financial issues that are bringing your score down, such as a tendency to max out credit cards or make late payments.

Credit inquiry removal letter template I am writing to request the removal of unauthorized credit inquiries on my (name of the credit bureau—Equifax, Experian and/or TransUnion) credit report. My latest credit report shows (number of hard inquiries you are disputing) credit inquiries that I did not authorize.

Your letter should clearly identify each item in your report you dispute, state the facts, explain why you dispute the information, and request that it be removed or corrected. You may want to enclose a copy of your credit report with the items in question circled.

Be Honest: Transparency is key. Acknowledge your credit issues without oversharing personal details. Stay Positive: Focus on your current situation and how it has improved. Proofread: Ensure there are no spelling or grammatical errors.

A credit repair company works on your behalf to remove this information by communicating with the credit bureaus (Experian, Equifax and TransUnion) and/or financial companies, like your bank or a debt collector, to dispute the errors.

One thing is certain — negative marks will eventually fall off your credit reports and no longer impact your scores. Hard inquiries fall off after two years (and only impact FICO scores for the first 12 months). Chapter 7 bankruptcies fall off 10 years. All other negative marks fall off after seven years.

Credit repair services aren't always reliable or truthful. In fact, the CFPB found that more than half of people who submitted complaints about credit repair companies cited “fraud or scam.” Thankfully, there are consumer protections.
