Description

The Listing Agreement Real Estate with Multiple Owners in Philadelphia is a formal contract that engages a specified agent to sell a property on behalf of multiple owners. This exclusive agreement allows the agent to market the property and negotiate sales terms, ensuring all efforts are coordinated through the agent. Sellers can choose to sell the property as a whole or in parts, setting a minimum sale price and defining payment terms. The agreement also establishes the duration of the listing, typically starting for a set period before automatically transitioning to a month-to-month basis, unless terminated by notice. Key features include the agent's responsibilities for advertising, inspections, and communication, while also outlining the commission structure for successful sales. This form is especially useful for attorneys, partners, owners, associates, paralegals, and legal assistants by providing a clear framework for property sales, facilitating coordination among multiple stakeholders, and ensuring compliance with legal standards. FAQ

The Pennsylvania Real Estate Commission states that the listing period cannot exceed 12 months.

Up to a certain point, it is legal to list your home with multiple Realtors in most states. It would be a logistical nightmare (we'll cover that in detail below), but it is still technically legal. The moment it becomes not okay is when you sign an exclusive agency listing with a particular broker or firm.

(a) A licensee may act as a dual agent if both parties consent in writing. (b) In addition to the duties required in § 35.292 (relating to duties of licensees generally), a dual agent owes the additional duties of: (1) Taking no action that is adverse or detrimental to either party's interest in the transaction.

(c) An exclusive listing agreement may not contain: (1) A listing period exceeding 1 year. (2) An automatic renewal clause. (3) A cancellation notice to terminate the agreement at the end of the listing period set forth in the agreement.

How to Cancel: In all cases, you must be given a copy of the contract, along with a Notice of Cancellation. This notice must include the date of the contract and the seller's name and address.

Timing – An action under the RESDL must be commenced within two years after the date of final settlement for the property (68 Pa. C.S.

The exclusive right to sell listing agreement is the most common type of agreement in real estate. Under this arrangement, the broker is given exclusive rights to market the property for a set period.

Listing agents represent home sellers — as the name suggests, they create and promote the listing for a home that's for sale. Somewhat confusingly, selling agents represent the purchaser's interests and are therefore also known as buyer's agents.

Also, under the statute of frauds, a listing agreement must be in writing and must be signed by the seller. (If the property has more than one owner, only one of them has to sign the listing.) The broker usually also signs the listing agreement, although her signature is not strictly required.

Signatories sign legal documents, international agreements, and contracts. These types of documents have multiple parties that need to sign the agreement. Signers are anyone who needs to provide a signature to legal documents.
