California liquor license requirements and laws. A California Alcohol Beverage Control (ABC) license isn't an instant process. From start to finish, a new license can take about 90 days. Transfers are slightly faster at around 75 days.
42 - On-Sale Beer & Wine - Public Premises Issued to bars and taverns. Authorizes the sale of beer and wine for consumption on or off the premises where sold. No distilled spirits may be on the premises. Minors are not allowed to enter and remain (see BPC § 25663.5 for exception, musicians).
A temporary permit cannot be issued for original licenses or premises-to-premises transfers. Check “yes” to request that a temporary permit be issued to the applicant. A temporary permit is good for 120 days and allows the applicant to sell alcoholic beverages during the transfer waiting period.
Any person wishing to obtain an alcoholic beverage license should apply at the nearest district office of the Department of Alcoholic Beverage Control. All parties concerned, applicants for new licenses or transferors (present licensees), and transferees (applicants) should be present.
If charged as a felony, California Business and Professions Code section 23300 can be punishable with a term of imprisonment of either 16 months, 2 years, or 3 years. If charged as a misdemeanor, California Business and Professions Code section 23300 can be punishable with a jail term not to exceed 180 days.
License Types 01 - Beer Manufacturer. Authorizes breweries to produce over 60,000 barrels of beer per year. 02 - Winegrower. 03 - Brandy Manufacturer. 04 - Distilled Spirits Manufacturer. 05 - Distilled Spirits Manufacturer's Agent. 06 - Still. 07 - Rectifier. 08 - Wine Rectifier.
The caterer must have a license obtained from the State of California Department of Alcoholic Beverage Control which enables the caterer to sell beer, wine and distilled spirits (hard liquor). If the caterer does not have this license, the private party cannot sell alcohol. No exceptions.
If your event involves a “private party” within the definition of this term, then you will not need a license. A private party is defined as an event that: Is not open to the public. Cannot be attended by anyone who is not specifically invited.
