Description

The parties may agree to a different performance. This is called an accord. When the accord is performed, this is called an accord and satisfaction. The original obligation is discharged. In order for there to be an accord and satisfaction, there must be a bona fide dispute; an agreement to settle the dispute; and the performance of the agreement. An example would be settlement of a lawsuit for breach of contract. The parties might settle for less than the amount called for under the contract.

FAQ

Who Qualifies for Unemployment Insurance? 1. To qualify, you must have earned at least $1,600 during a recent 12-month period (known as the base period) and you must have earned at least $440 outside of the base period quarter in which your earnings were the highest.

Reasons include a growing population, lack of quality education and skill development, inadequate job opportunities, slow economic growth, and insufficient investment in certain sectors.

Your earnings for the week must be less than your weekly benefit amount (not including your dependent allowance). Any wages earned that are greater than 50% of your weekly benefit amount will be deducted from your unemployment insurance benefits for that week.

File for benefits online at IDES.Illinois or at an IDES office. If you are uncertain about your eligibility for benefits, call IDES Claimant Services for further information. You must also register with the Illinois Employment Service system at IllinoisJobLink, or you may register at an IDES office.

IDES will review your filed claim. In roughly 7-10 business days, you will receive a UI Finding letter detailing the eligibility results of the claim. The Finding letter will contain information about your benefits and your certification day.

You must be unemployed through no fault of your own, as defined by Illinois law -- not fired for cause (most cases, if you quit voluntarily, one is not eligible for these benefits. However, if you resign for good cause you may be able to collect unemployment benefits); You must be able, available, and looking for work.

Call the Claimant Services Center at (800) 244-5631 to speak with an expert.

Read the "Prepare for Your Appeal Hearing" brochure thoroughly. Decide what information will help establish evidence in your favor. Choose witnesses with direct personal knowledge or experience in your case. Mail and/or fax to IDES and other parties involved, any documents you would like to use in your case.

File an Appeal The appeal must be in writing or you may use form APL124F: Notice of Appeal/Board of Review. You must appeal within 30 days of the date of the Decision's issue. You should state why you are appealing and include the docket number of the Referee's Decision.

You have the right to appeal any decision denying your benefits. If you have any questions about your appeal rights, contact IDES. If you filed an appeal, continue to file your certification for your weeks of unemployment even though you may not receive benefits until the appeal is decided.
