Number of interrogatories allowed. - Without leave of court, a party may not serve a total of more than 50 interrogatories and such limit is a cumulative, not a "per set" limit.

Interrogatories are a discovery device used by a party, usually a Defendant, to enable the individual to learn the facts that are the basis for, or support, a pleading with which he or she has been served by the opposing party.

The original form interrogatories and signed proof of service should be retained for your records. If the other party does not respond to your requests, you may use these documents to support a motion to have the court compel responses.

You must respond to any interrogatories you receive within 30 days. If a defendant is served with interrogatories at the same time as they are served with a complaint, they have 45 days in which to respond. The court may extend the amount of time that someone has to respond to the questions.

Discovery can be obtained through depositions, written interrogatories, physical and mental examinations, and requests for admission.

Interrogatories may, without leave of court, be served upon the plaintiff after filing of the complaint and upon any other party with or after service of the summons and complaint upon that party.

(2) Each interrogatory shall be answered separately and fully in writing under oath, unless it is objected to, in which event the reasons for objection shall be stated in lieu of an answer. The answers are to be signed by the person making them, and the objections signed by the attorney making them.
