FAQ

A Request for Production (also known as a Demand for Inspection) asks the other side to produce and allow copying or inspection and measuring of a document or thing.

If you are served with interrogatories, you are required to reply with the answers within 30 days of the interrogatories being served. Any objections by the party in receipt of the interrogatories must also be submitted within that 30-day period.

When a party to a civil case needs to get information from the other side, she can serve the other side with written requests called “discovery requests.” These requests might include: Interrogatories, which are written questions about things that are relevant or important to the case. (NRCP 33; JCRCP 33)

If you don't respond within the time given, the opposing party may file a motion to compel your compliance with the court.

If you do not respond, then the other side will request entry of default. The Court will then wait a period of time and then assume that you have waived the right to contest the allegations--they will be deemed proven true.

You have 30 days to respond to Form Interrogatories. If you were served by mail, you typically have 35 days from the date of mailing to respond. In eviction (unlawful detainer) cases the time is much shorter.

The party to whom the interrogatories are directed must serve the answers and any objections within 30 days after the service of the interrogatories, except that a defendant may serve answers or objections within 45 days after service of the process and initial pleading on that defendant.

Interrogatories are a discovery device used by a party, usually a Defendant, to enable the individual to learn the facts that are the basis for, or support, a pleading with which he or she has been served by the opposing party.

The original or any copy of the answers to interrogatories may be filed in compliance with Florida Rule of General Practice Judicial Administration 2.425 and rule 1.280(g) by any party when the court should consider the answers to interrogatories in determining any matter pending before the court.

Read each question (interrogatory) very carefully. Answer only the question that is asked, and avoid the temptation to over-explain your answer. If the question contains several parts, you may break your answer into parts as well. It is also possible that you might object to the question.
