Description

A retail installment agreement is an agreement signed by the Purchaser involving a finance charge and providing for the sale of goods or services. Federal and some State Laws (Consumer Credit Protection Acts) require the disclosure of what the Purchaser is being charged for the credit he/she is receiving. These disclosures include such things as the amount being financed; finance charges; the annual percentage rate; and the number of payments and when due. However, such disclosures are usually only required when a person regularly extends consumer credit (e.g. more than 25 times in the preceding calendar year).

This form is for a casual seller who does not enter into such transactions on a regular basis. It can also be used in commercial transactions (e.g., credit that is not being extended primarily for personal, family, or household purposes).

The Purchaser in this form grants the Seller a security interest in the collateral being sold. A security interest is an interest in personal property or fixtures that secures payment or performance of an obligation. The Seller requires the Purchaser to secure the obligation with the personal property being purchased so that if the Purchaser does not pay as promised, the Purchaser can take the collateral back, sell it, and apply the proceeds against the unpaid obligation of the Purchaser.

Responsible Managing Employee. RME. Title of an employee who serves as the qualifying individual on a sole owner, partnership, corporate, or limited liability company license.

A Responsible Managing Employee or RME is a licensed individual who is permanently employed by a construction company. The California CSLB issues the RMEs' license to qualify for the company that they work for.

How to Start an LLC for Your Construction Company Choose a Standout Name. Designate a Registered Agent. Pick a Principal Address (or Get a Virtual Address) ... Draft an Operating Agreement. File the Articles of Organization. Get an EIN. Obtain the Proper Permits, Licenses, and Insurance. Register for State Taxes.

Anything over $500 worth of home improvements requires a license contractor. Getting permits is up to the homeowner unless the contractor said they would do it. Homeowner can file a complaint against the contractor through the state website. Homeowners can also use the small claims court system to recover damages.

You may have heard of the term RMO —this stands for Responsible Managing Officer: a qualified individual who can sponsor your own company for a new contractors license. If you have a trusted family/friend who is a licensed CA contractor, they can be your RMO.

The difference is the individual's title. RMO stands for Responsible Managing Officer, so the person would need to be an Officer of the corporation. If the person is not an Officer, they would be an RME, which stands for Responsible Managing Employee. RME's can only Qualify one license at a time.

The easiest kind of contractor's license is a Class “B” Contractor's License. This license allows you to do general contracting work. There are also licenses for specialty contracting work called a Class “C” Contractor's License. These are for jobs like plumbing or electrical.

For corporations, the qualifying individual is known as either the responsible managing employee (“RME”) or, if an officer, the responsible managing officer (“RMO”). (Bus. & Prof. Code § 7065(c)(3).)
