FAQ

Today, we're going to be talking about the Shop and Office Employees (Regulation of Employment and Remuneration) Act No 19 of 1954. This act was written about the labour laws in Sri Lanka. The laws in this act apply to every employee working in Shops and Offices in Sri Lanka.

AN ACT to declare every Full Moon Poya Day and Sunday as public holidays; to make special provision for the observance of the Full Moon Poya Day; and to make provision in regard to matters connected therewith or incidental thereto.

Wages Board Ordinance: A normal working week cannot exceed 48 hours. All work over and beyond that period is considered overtime. A maximum of 12 hours of overtime per week is permitted.

Short Leave is the time off taken by an employee for a very short time that is less than a half day. Generally it happens when he/she has to go somewhere on an urgent basis. It can mean 2 hours coming late to the office, taking a 2 hour gap in between or leaving 2 hours early.

The employee is permitted to 14 days of annual leave complete with the full salary for each concluded year of service. Hence, employees are not entitled to annual leave on the first year of employment. Annual leave for the second year of employment is accrued based on the date the employee joined service.

For example, under the TEWA, the calculation is as follows: For the first 5 years of service, it's 2.5 months of salary for each completed year. For the 6th to 14th year of service, it's 2 months of salary for each completed year. For the 15th to 19th year of service, it's 1.5 months of salary for each completed year.

Washington is an employment-at-will state, which means that without a written employee contract, employees can be terminated for any reason at any time, provided that the reason is not discriminatory and that the employer is not retaliating against the employee for a rightful action.

The Act provides that the Minimum Retirement Age in Sri Lanka is 60 years of age.
