Statutory Maternity Leave Eligible employees can take up to 52 weeks' maternity leave. The first 26 weeks is known as 'Ordinary Maternity Leave', the last 26 weeks as 'Additional Maternity Leave'. The earliest that leave can be taken is 11 weeks before the expected week of childbirth, unless the baby is born early.

From 6 April 2024 the redundancy protected period for pregnant employees or those taking maternity leave has been extended. Before this they were only protected while on maternity leave. Employees have the extended protection if they: notify their employer of their pregnancy or start maternity leave after 6 April 2024.

Our Expectant Mother Courses Pregnant employees can continue to work the average 40 hours a week in the UK or the hours that they were working previously, before they became pregnant.

If they become pregnant on maternity leave If the employee becomes pregnant while on maternity leave, they're entitled to another 52 weeks' maternity leave. By law, the employee cannot start their next maternity leave until the 11th week before their baby is due.

Standard Recommendation: Many women start their maternity leave around 4 to 6 weeks before their due date. This allows time for rest and preparation for the baby's arrival.

You must tell your employer when you plan to start maternity leave no later than 15 weeks before your baby is due. After your baby is born, by law you must: start your maternity leave (if you have not already) take off at least 2 weeks (4 weeks if you work in a factory) – this is known as 'compulsory maternity leave'
