New overtime thresholds will be phased-in as described above until they reach 8 hours per day and 40 hours per week by 2022 (for employers of more than 25 employees) or by 2025 (for employers of 25 or fewer employees).
The DOL previously issued a similar overtime final rule in 2019 that increased the minimum salary threshold from $455 per week to $684 per week. Unlike the 2024 Final Rule, the 2019 rule withstood legal challenge, and was upheld this past September by the U.S. District Court of Appeals for the Fifth Circuit.
The standard definition of full-time hours in California is between 32 and 40 hours per week. However, it's important to note that after the implementation of the ACA, workers are considered part-time if they work less than 30 hours per week, and full-time if they work 30 hours a week or more.
