Construction noise is covered by Chapter 12.08. 440 in Title 12 of the County Codes. Most construction must take place between a.m. and p.m. during normal weekdays. However, emergency repairs may be performed as necessary.

Be aware of the City of Tucson's noise ordinance. It prohibits noise over 70 dB from 7 a.m. to 10 p.m. and 62 dB from 10 p.m. to 7 a.m. in residential areas.

16-31. Excessive noise. (a) Maximum permissible sound levels. No person shall conduct or permit any activity that produces a dB(A) beyond that person's property line exceeding the levels specified in Table I.

Only a hearing officer has the authority to grant more than one 30-day extension. You must file a motion (online, in person or by mail) with the court if additional time is needed.

Construction work (residential): From April 15th to October 15th, inclusive, all construction work in or within 500 feet of Rural or Residential zones as per the Maricopa County Zoning Ordinance, and within 1,500 feet of an occupied residence, shall not begin prior to a.m. and must stop by p.m. each day.

Other type construction (commercial and industrial zones): Construction and repair work in commercial and industrial zones, not within five hundred (500) feet of a residential property, shall not begin prior to a.m. and must stop by p.m. or at such other times as authorized by permit.

Generally, for extension requests, most judges require both parties to “confer” (communicate with one another) and try to obtain the other party's consent for extra time. If the other party does not give their consent, you can still move forward with filing your request.

Write the judge a letter as soon as you know you're not able to attend court. Explain the reasons why you have to miss your court date, and provide any documentation for proof, like a note from your doctor or work supervisor. At the end of the letter, request a new court date.

Please contact the court prior to your court date if you need to reschedule your arraignment. Requests for continuances (Motion to Continue) for all other hearings must be made in writing no later than five days prior to the scheduled hearing.
