A probate court (sometimes called a surrogate court) is a court that has competence in a jurisdiction to deal with matters of probate and the administration of estates. In some jurisdictions, such courts may be referred to as orphans' courts or courts of ordinary.
A surrogate is a Constitutional Officer who is elected every five years. The Surrogate serves as Deputy Clerk of the Superior Court, Chancery Division, Probate Part, and Chancery Division Family Part for adoptions, as well as Judge of the Surrogate's Court.

Surrogate judges have all of the same abilities and duties as regularly appointed judges. Becoming a surrogate judge gives retired judges the ability to continue their judicial duties on their own time.
