FINRA requires investors and other parties to file their arbitration claims via the DR Portal—except for investors representing themselves, who have the option to file by mail. If the parties have not appointed any arbitrator(s) and have not provided another method of appointment, then generally the case manager submits a list of potential arbitrators to the parties, who then may strike any names and rank the remaining in order of preference.

States have varying requirements for arbitrators, but most require you to have at least a bachelor's degree in law, political science or a similar field. You can gain experience for this role by completing internships and working in entry-level positions under the supervision of an experienced arbitrator.

Honing basic lawyering skills like research, writing, and trial advocacy can help aspiring arbitrators build a foundation from which to transition to a career as a neutral.

The arbitrator will explain the process. Each side may present an uninterrupted opening statement setting forth its position as to the facts and the law. After opening statements, the parties present their evidence and witnesses. The arbitrator swears in the witnesses and makes rulings on the admissibility of evidence.

Under CCP § 583.310, an action must be brought to trial within five years after it is commenced against the defendant.
