File a contempt of court In a contempt case, you ask the judge to enforce the order and make a finding that the other parent willfully disobeyed the court order. This is very complicated and can have serious consequences for the other parent, even jail time.
Riverside Superior Court Local Rule 3116 provides: Unless otherwise specified in the Order to Show Cause, any response in opposition to an Order to Show Case (a) shall be in the form of a written declaration and (b) shall be filed no less than four court days before the hearing on the Order to Show Cause.
APPEARING REMOTELY AT NON-EVIDENTIARY HEARINGS No written request to appear remotely is necessary. Persons intending to appear remotely shall notify all opposing parties of their intention before the hearing. That notice may be given informally, including by telephone, email, or text message.
Perjury under California Penal Code Section 118 PC is a felony offense that can carry prison sentences of up to four years and could include substantial court fines. An allegation of aggravated perjury may apply if the act of perjury led to the conviction and execution of another person.
This rule is essentially forcing parties to try to settle issues in their case before going to trial. If Local Rule 5153 is not complied with, the Court will not allow your case to go forward until these procedures are met.
California Code of Civil Procedure 1218(c) states that for each act of contempt, the convicted spouse or parent shall be fined up to $1000 and/or imprisoned for up to five days. Notice that this is for each act of contempt. In support proceedings, each monthly payment is a separate act.
