When you are unhappy with the outcome of an arbitration award, the matter must be taken on review within 6 six weeks from receiving the arbitration award.

Enforcing arbitration as a judgment can be done by asking a local court to approve that award and convert it (or “reduce it”) into a court-enforceable judgment. Once this is done with the court registry, the court will confirm the award and enter judgment.

The proper method for seeking to enforce an arbitration award under the Federal Act is to file a motion for confirmation in the appropriate court. That court must grant the motion and enter judgment on the confirmation order unless the opposing party files a timely motion to vacate, modify, or correct the award.

If you are new to the DR Portal, please create an account. Login to the DR Portal and select “File a New Arbitration Claim” in the left column.

Instead, if a party wins in the arbitration and the other party does not do what the award says, the winning party may go to court to “confirm” the arbitration award. Under AAA rules, parties to AAA cases agree that the arbitration award can be entered as a judgment in any federal or state court with jurisdiction.

Section 29A(4) of the Arbitration Act provides that if the award is not issued within the specified period of 12 months or a further extended period of six months, then the mandate of the arbitrator(s) would be terminated subject to further extension by the Civil Court or the relevant High Court (“HC”).
