FAQ

At the time of the 1993 fieldwork, Vietnam had just adopted a new Land Law which gave farmers 20-year rights on land used for annual crops, and 50-year rights on land used for perennial crops such as tree crops.

The land belongs to all the people of Vietnam, but the State represents the owner. Land ownership in Vietnam includes three fundamental rights: the right to possess, use, and dispose of land. When the State allocates land to land users, it only assigns them the right to own and use land.

Construction Law No. 50/2014/QH13. This Law, consisting of 168 articles divided into ten Chapters, prescribes the rights, obligations and responsibilities of agencies, organizations and individuals and the state management in construction investment activities.

The National Assembly promulgates the Law on Enterprises. This Law provides for establishment, management, reorganization, dissolution and relevant activities of enterprises, including limited liability companies, joint stock companies, partnerships and sole proprietorships; groups of companies.

The law of the land is the whole body of valid laws, statutory or otherwise, existing and in force in a country or jurisdiction at a particular date. Every valid statute is the “law of the land” with respect to its subject matter.

Private ownership of land is not permitted in Vietnam and the people hold all ownership rights with the State as the administrator. However, the laws of Vietnam allow ownership of a right to use land. This right is called the Land Use Right (“LUR”).

Vietnam's supreme legislative body, the National Assembly, has the power to make and amend the Constitution (Article 70(1) of the 2013 Constitution). Making and amending constitutions does not require referenda or referral to regional or local governments.
