Meal & Rest Breaks These periods are critical for maintaining the well-being and alertness of the caregiver. The duration and frequency of meal and rest breaks are as follows: One 30-minute meal break for shifts over 5 hours. One 10-minute rest break for shifts ranging from 3.5-6 hours.
One 30-minute unpaid meal break for work periods more than 5 hours; a second meal period of 30 minutes if the work period is more than 10 hours in a day. An employee may agree in writing to take an on-duty meal period only when the nature of the work prevents the employee from being relieved of all duties.
California also has exemptions for various industries concerning meal and rest break requirements. These industries include healthcare, construction, commercial drivers, union employees, public agencies, the motion picture industry, publically-owned electric utilities, and security officers.
An employer and his helper alike may terminate the contract prior to its expiry by giving not less than one month's notice in writing or by paying one month's wages to the other party.
