Exemptions: While not required, individuals may choose to be excused from jury duty if they are over 75 years old, have legal custody of a child under 12 without adequate supervision, or are full-time students.
If you have received a summons, you may request to be excused or postpone your service for any of the reasons listed below: Having active care of a child or children under ten years of age, and not employed outside the home. Over 70 years of age. Caring for an aged or infirmed person.
A prospective juror may be excused if he/she: Has a physical or mental disability that would prevent him/her from serving. Must provide actual and necessary care for another and alternate arrangements are not feasible. Is unable to read or understand the English language. Over 75 years of age.
Statutory Penalties for Non Compliance A person who receives a summons for jury service and fails to answer the summons as directed by the summons, is subject to a contempt action that is punishable by a fine of not less than $100 nor more than $1,000.
Failing to appear for jury duty is considered contempt of court, which can carry serious penalties. You may face fines or, in extreme cases, additional legal action. In some cases, the court might issue a “show cause” order, requiring you to explain why you did not attend jury duty.
If the state approves the application, a certificate and exemption number is issued by the state. These certificates are generally issued for one or two-year periods.
A certificate of exemption is issued on application to prospective students who have obtained a Senior Certificate without endorsement or equivalent foreign school-leaving qualification, which meets the requirements of the published regulations and wishes to pursue first degree studies at a South African university.
