State to the court that you would like a restraining order and what you would like the court to order. Be as specific as possible. At the hearing, you must prove that the abuser has committed an act(s) of domestic violence (as defined by the law). You must also convince a judge that you need the protection and the specific things you asked for in the petition.
In most states, if you or your children are subject to domestic violence, threats of domestic violence, or stalking, you may apply for legal protection.
You must file your application in the justice court for the township where the stalking, aggravated stalking, or harassment took place. Stalking or harassment is committed "where the conduct occurred" or "where the person who was affected by the conduct was located at the time that the conduct occurred." (NRS 200.581.)
The order of protection has nothing to do with whether you can get married.
The burden of proof is on the protected party to prove to the court by a preponderance of the evidence that there is a reasonable apprehension of future abuse.
