FAQ

To get a no contact order, a person must file a claim with their local court — and often, they will have to go before a judge. When filing a complaint, the petitioner must file in their own jurisdiction or the jurisdiction of the assailant.

At the courthouse, tell the clerk of court that you want to file a petition for a protection from abuse order. If you are in immediate danger, tell the clerk you also want an emergency (ex parte) order. The clerk will give you the forms. You will also find links to forms online at our AL Download Court Forms page.

Examples: “I am asking the court to grant me a _____ month/year injunction.” “I want no contact in person, at home, by phone, at work, by mail or through third parties.” “I would consider any contact in the future to be a violation.” Tell the court why you would like the temporary restraining order injunction.

Obtain a petition for a protective order from either the Montgomery County District Court Clerk or you can visit the court form search. File the petition with a Circuit or District Court clerk during normal business hours. You will be directed to a courtroom as soon as a judge is available to hear your case.

ALABAMA PROTECTION ORDERS Victims who need protection may go to the local circuit court and request a Petition for a Protection From Abuse Order from the circuit clerk. Victims may file this petition without costs and without assistance from an attorney.

After a Petition for a Protection Order is filed, a hearing will be held at which the plaintiff will need to prove, through testimony and evidence, that the abuse occurred. The defendant is allowed to be present and offer evidence against the allegations in the petition. The defendant may be represented by an attorney.

Using the facts of the incident only, keep your statement brief and to the point. Briefly describe the most recent incident of abuse and/or threats of abuse or other behaviors. Focus on the actual behavior. Do not include prior incidents, (that will be the next paragraph).

One of the primary restrictions imposed by a restraining order in California is prohibiting any form of contact between the individual subject to the order and the protected person.

A judge will hear all of the evidence and decide whether to extend your TRO beyond 180 days. If the judge believes that a final order of protection should be issued, s/he will grant you an order that can last for as long as s/he determines is necessary.
