The state offers two different types of certificates that can restore gun rights in some cases. Those seeking to regain their firearm rights must apply for a Certificate of Good Conduct from the New York State Board of Parole or a Certificate of Relief from Disabilities is granted by the court.
The NY SAFE Act prohibits possession of a magazine that has the capacity to hold more than ten (10) rounds of ammunition regardless of when it was manufactured or when it was obtained. It also prohibits possession of a magazine if it is loaded with more than seven (7) rounds of ammunition, unless you are at a range.
New York law prohibits the possession of a “loaded” handgun (or any loaded firearm) outside of a person's home or place of business without a carry license. NY Penal Law § 265.03(3).
