Constitutional Amendments – Amendment 2 – “The Right to Keep and Bear Arms” Amendment Two to the Constitution was ratified on December 15, 1791. It protects the right for Americans to possess weapons for the protection of themselves, their rights, and their property.
In New Jersey, you are allowed to open carry your handgun at your home or other private property that you own. However, in order to transport your handgun, it must be properly stored. Proper storage will involve carrying the handgun unloaded and in a closed and fastened gun box, case, package.
Been convicted of aggravated assault, arson, burglary, escape, extortion, homicide, kidnapping, robbery, sexual assault; bias intimidation or endangering the welfare of a child; or any weapons offense; or any domestic violence offense including crime such as harassment, stalking or criminal restraint.
You are legally allowed to keep a loaded gun in your New Jersey home or business. While New Jersey does not have a 'stand your ground' law, the use of force is often allowed if you believe you are protecting yourself. However, a person can get in trouble if they shoot, and kill, someone, without good reason.
Keep your gun in your nightstand drawer or on your person at all times. Kids can't get unauthorized access this way. Locking it in a safe in the closet makes it rather pointless when someone breaks into your apartment at 3 in the morning, or threatens you at knifepoint outside the building.
You do not need to register a handgun if it is kept in your home and not being carried. NJ only requires it to be registered if you are carrying it and getting a permit to carry. Other that that you are entitled to have a weapon in your home.
Open carry is not addressed in New Jersey state law, although a New Jersey Permit to Carry a Handgun (PCH) is required to carry a firearm in the state. A person can keep and carry any legal firearm in his or her place of business, residence, premises or other land owned or possessed.
In short, the Supreme Court did its job by announcing that the Second Amendment does not protect assault weapons—precisely because they are meant for the battlefield and are not “in common use at the time for lawful purposes.” Id. at 624-25, 627-28; Kolbe, 849 F. 3d at 131.

Currently, the State Constitution provides that the people of New Jersey have the right of enjoying and defending life and liberty, but does not explicitly include a right to firearm ownership.
