Constitutional Amendments – Amendment 7 – “The Right to Jury Trial in Civil Affairs” Amendment Seven to the Constitution was ratified on December 15, 1791. It protects the right for citizens to have a jury trial in federal courts with civil cases where the claim exceeds a certain dollar value.

The procedure for criminal cases is very similar to the procedure for civil cases. However, 20 prospective jurors are called for a felony trial, and the final jury will have 12 members. For a misdemeanor case, the final jury will have seven members.

Only in a circuit court is a jury provided for the trial of many of these disputes and controversies. The Virginia circuit court system is composed of 31 judicial circuits with 120 separate circuit courts in the various counties and cities of the Commonwealth.

In both a civil and criminal case, the judge instructs jurors on the standards to be applied in the case. In criminal trials, 12 jurors are impaneled. In most civil cases, six jurors sit to hear a matter, although there may be as many as 12 jurors.

In civil cases, jury decisions should be unanimous wherever feasible. A less-than-unanimous decision should be accepted only after jurors have deliberated for a reasonable period of time and if concurred in by at least five-sixths of the jurors.
