For jury instructions to be effective, they must be clear and simple. Sentences should be short; instruc- • tions should contain no more than a few sentences, cover only one topic, and be directly related to the circumstances of the case (they should not be abstract statements of the law).
However, there must be at least twelve votes in favor of an indictment. The grand jury consists of twenty-three jurors. In New York State no grand jury can conduct business unless sixteen of the grand jurors be present.
Each juror is assigned a unique number called your "Juror Number". This number is used to identify the person addressing the Court and also when you submit a request for excuse.
Grand juries also do not receive any exculpatory evidence, meaning that they cannot hear evidence that goes against the prosecutor's case. They do not hear any evidence that suggests the innocence of the accused persons.
Grand Jury Consists of 16-23 grand jurors. Proceedings are private. Grand jurors generally serve up to 18 months, but can serve for up to 24 months, if an extension is granted by a judge. Grand jurors consider multiple cases over the course of their term of service.
How Many Grand Jurors? A grand jury has 23 members. In order to conduct any business - hearing evidence or deliberating - a “quorum” of at least 16 grand jurors must be present.
The questionnaires are used to determine if you are qualified to serve as a juror. You must complete the form either by completing the online eJuror questionnaire or filling out the paper questionnaire, signing it and returning it in the envelope provided within ten (10) days.
In New York, the grand jury is an arm of a superior court. In Orange County, the superior court is Orange County Court. A grand jury consists of 23 citizens, who the court selects at random, and who are intended to reflect a fair cross-section of the community.
When a defendant fails to appear in court (“defaults”) the court will issue a judgment against the defendant. A judgment issued under those circumstances is commonly known as a “default judgment.” The court usually awards the plaintiff the amount demanded in the complaint, plus interest and court costs.
