A defendant may in writing waive a jury trial with the consent of the state. 1968 Adoption. This is the same as Federal Rule of Criminal Procedure 23(a). This changes existing law by providing for consent of state.

The right to a jury trial refers to the right provided by the Sixth and Seventh Amendments. The Sixth Amendment states that in all criminal prosecutions, the accused criminal has the right to a trial by an impartial jury of the state and district in which the individual allegedly committed a crime.

Ing to the Supreme Court, the jury-trial right applies only when "serious" offenses are at hand—petty offenses don't invoke it. For purposes of this right, a serious offense is one that carries a potential sentence of more than six months' imprisonment.

Section 40.23 of the Florida Statutes states that “failure to attend as a juror upon being duly summoned may result in a fine not to exceed $100.” If you fail to report for juror service, you will receive a failure to appear letter instructing you to contact the jury department.
