बंदी प्रत्यक्षीकरण वह रिट है जिसकी कल्पना एक ऐसे व्यक्ति को त्वरित न्याय प्रदान करने के लिये एक प्रभावी साधन के रूप में की गई थी जिसनेबिना किसी कानूनी औचित्य केअपनी व्यक्तिगत स्वतंत्रता खो दी है। भारत मेंबंदी प्रत्यक्षीकरण की रिट जारी करनेकी शक्ति केवल सर्वोच्च न्यायालय और उच्च न्यायालय मेंनिहित है।
भारत का उच्चतम न्यायालय (अनुच्छेद 32 के तहत ) एवं राज्यों के उच्च न्यायालय (अनुच्छेद 226 के तहत ) 5 प्रकार के “रिट” जारी कर सकते हैं । ये हैं- बंदी प्रत्यक्षीकरण, परमादेश, प्रतिषेध, उत्प्रेषण एवं अधिकार पृच्छा । ये रिट, ब्रिटिश कानून से लिए गए हैं । इन्हें राजा द्वारा जारी किया जाता था ।
