The writ of habeas corpus is the great remedy of the citizen or subject against arbitrary or illegal imprisonment; it is the mode by which the judicial power speedily and effectually protects the personal liberty of every individual, and repels the injustice of unconstitutional laws and despotic governments.

Shivkant Shukla, AIR 1976 SC 1207 (popularly known as Habeas Corpus Case) and its culmination in Justice K.S. Puttaswamy (Retd.) and another v. Union of India and others, AIR 2017 SC 4161 (popularly known as Right to Privacy Case).

Habeas Corpus which literally means “to produce the body” is a protection against illegal and arbitrary detention of a person. The petitions for habeas corpus determine whether the individual has been arrested ing to the procedure established by law.

It's been called the second Magna Carta by some, and the “great writ” by others. What we are referring to is habeas corpus, a Latin phrase meaning “you should have the body.” Put most simply, habeas corpus allows a person who has been detained the chance to challenge that detention in court.

Traditionally, the writ of habeas corpus is an order issued by a court directing a person detaining another to produce the physical body of the detainee at a designated time and place, and to explain the reason for the detention. HABEAS CORPUS HAS ONLY ONE OBJECTIVE: to inquire into the cause of the detention.

A writ of habeas corpus orders the custodian of an individual in custody to produce the individual before the court to make an inquiry concerning his or her detention, to appear for prosecution (ad prosequendum) or to appear to testify (ad testificandum).
