In order to register, persons shall execute an affidavit of domestic partnership and submit it to the County Clerk, who shall maintain a registry of domestic partnerships. Both parties to the partnership shall be present when the affidavit is submitted.
Virginia is a very popular destination for elopements because there is no waiting period after obtaining a marriage license – engaged couples can apply for and pick up their Virginia marriage license at the courthouse and get married the same day. This makes Virginia an ideal place to get married quickly and easily.
A couple who intends to be married in New York State must apply in person for a marriage license. The application for a license must be sworn and signed in the presence of the issuing clerk by both individuals. A representative cannot apply for the license on behalf of the couple.

Once a marriage license is issued, there is no waiting period. However, the marriage license is valid for 60 calendar days and the marriage must take place in Virginia.
