5 Day Notice to Pay Rent or Lease Terminates ?ˆ“ Residential - This form is used by a landlord to demand payment of overdue rent from a residential tenant within 5 days from giving the notice, in accordance with the laws of your state. (Note: If a written agreement provides for a longer notice, use the notice length stated in the agreement). "Residential" includes a house, apartment, or condo. FAQ

On September 4, the CDC issued an eviction moratorium that protects many renters from being evicted for non-payment of rent through December 31st. For more information, see the Resources for Residential Renters section above. If you are a landlord connected to RI Housing, see here.

Pursuant to RI law, to evict a month-to-month tenant, a landlord must send a 30 day notice to terminate the month to month tenancy. When the 30 day time period expires, then the landlord or the landlord's Rhode Island eviction lawyer may file a complaint for eviction in Providence District Court.

An eviction can stay on your public record for at least seven years. After this period, evictions fall off your public records, including your credit report and rental history. Evictions can impact your credit score and your ability to rent, but there are ways to improve your chances of renting after an eviction.

In the state of Rhode Island, this costs $80 in filing fees. The reason for the eviction determines when and how the summons and complaint must be served on the tenant.

Is there a moratorium on evictions in Rhode Island? No. This means there is currently no order banning evictions of any kind. The lack of a moratorium does not mean you can be immediately evicted from your home if you are behind on rent.
