2.15 Dismissal of Some Charges Against Defendant is a legal action taken by a court to drop some of the charges that have been brought against a defendant. The court may choose to dismiss some charges after considering evidence or testimony presented during a hearing. The court may also dismiss charges if the prosecutor decides they are not relevant or necessary to the case. There are two types of dismissal of some charges against a defendant: voluntary dismissal and involuntary dismissal. A voluntary dismissal is requested by the prosecutor or defendant and accepted by the court, while an involuntary dismissal is issued by the court without the consent of either party.
