Application for Second or Successive Petition Under 28 U.S.C. 2254 (state) is a legal document used to request review of a state court criminal conviction or sentence in federal court. It is typically filed by a person who has already filed a habeas corpus petition in the federal court, but whose petition was denied. The application must be filed in the federal court of appeals in the circuit in which the sentence was imposed and must include all the relevant facts and legal arguments in support of the application. There are two types of Application for Second or Successive Petition Under 28 U.S.C. 2254 (state): a motion for authorization to file a second or successive petition and a motion for leave to file a second or successive petition. The motion for authorization is the first step in the process and is usually required before the motion for leave can be filed.
