Description

The Employment Law Handbook serves as a comprehensive guide to the rights, protections, and benefits afforded to employees in San Diego under both federal and state laws. Key features include provisions on wages, hours, leaves, child labor, workplace safety, and anti-discrimination laws, highlighting the importance of minimum wage and overtime payments, as governed by the Fair Labor Standards Act. This document emphasizes the Family and Medical Leave Act, which allows eligible employees to take job-protected leave for family and medical reasons, and provides a framework for addressing work-related injuries through workers' compensation. Filling out the forms as prompted encourages users to identify their rights, while editing and understanding the provisions can be critical for compliance and advocacy. Specific use cases for this Handbook include consulting for legal advice, ensuring fair workplace practices, and addressing unjust termination or discrimination cases. This Handbook is particularly beneficial for attorneys, legal partners, and paralegals seeking detailed employee rights legislation, while small business owners can utilize it to understand their obligations toward employees, thus fostering a fair working environment.

The California Supreme Court has concluded that California's employment laws govern all work performed within the state, regardless of the residence or domicile of the worker.

All workers have rights on the job. In California, workers are protected by labor laws. It does not matter where you were born or what your legal status is. Once you are hired, you have rights.

In general, when an individual resides in California, they are subject to California's comprehensive and protective labor laws regardless of where their employer is located. California laws also apply to those who are legal residents of other states but are working in California.

The Professional Exemption sets out eight specific professions (law, medicine, dentistry, optometry, architecture, engineering, teaching, and accounting) that are exempt from the first 12 sections of the Wage Orders. It also addresses certain other professions, including nurses, pharmacists and software coders.

Our employment attorneys have found that employers typically round to the nearest 15 minutes or quarter-hour. This allows for the “7 minute rule,” where: the first 7 minutes to the increment, 1 through 7, are rounded down, and. the final 7 minutes, or 8-15, are rounded up.

If you are terminated for an unlawful reason it can be a wrongful termination, you are entitled to a final paycheck, you are entitled to a notice period before certain mass layoffs, and. you can be constructively terminated.
