FAQ

The Transfer on Death Deed (?TODD?) is a great alternative to transfer Washington State Real Estate and avoid probate. It works equally as well for any Washington State property owner, whether a U.S. Citizen, U.S. Tax Resident, or Canadian Non-U.S. Resident.

In 2014, the Washington State Legislature enacted the Uniform Real Property Transfer on Death Act (RCW 64.80). Recording requires you to pay $215.50 per recorded deed (plus postage for delivery and return to you) and wait months for the original (you can't print out a copy) to be recorded by mail.

When the owner dies, the beneficiary named in the TOD deed form automatically becomes the legal owner of the property, without the need for probate. The Washington state legislature first authorized the Washington TOD deed on June 12, 2014.

Recording (RCW 65.08. 070) ? All deeds must be delivered and submitted to the County Recorder's Office (See List of Counties) in the jurisdiction of the property. Signing (RCW 64.04. 020) ? All deeds must be signed with the Grantor(s) in the presence of a Notary Public.

To transfer title to real property from the name of the two spouses to the one surviving spouse, the agreement needs to be recorded with the county recorder's office, along with a certified copy of the death certificate. WAC 458-61A-202(8)(a).
