Delaware Consent Order - Guardian of the Person (fill-in form)

Custody is determined in Family Court. Guardianship is a court-ordered relationship where an adult is appointed by the court to care for a minor child ("ward") whose circumstances require it, and to make decisions about the child's education, support and maintenance.Guardianship is determined in Probate Court.

There are two types of guardianships, a full guardianship and a limited guardianship.

The names of the forms are usually: Petition for Appointment of Guardian (or Petition for Appointment of Guardian of Minor) Petition for Conservatorship (when dealing with an incompetent adult) Order Appointing Guardian.

A guardianship action is initiated with the filing of a Petition to Appoint a Guardian (the Petition) with the Court of Chancery (the Court). The requirements for the contents of the Petition are set forth in Chancery Court Rule 175.

The Guardian's Allowance rate is £18 a week. You get it on top of Child Benefit and it's tax-free. You must tell the Guardian's Allowance Unit about certain changes to your circumstances.

A guardian of property is someone the court names to manage money and property for someone else whom the court has found cannot manage it alone. Sometimes a guardian of property is also appointed as guardian of the person.

Guardianship is when a court orders someone other than the child's parent to: Have custody of the child; or. Manage the child's property (called "estate"); or. Both.

This is a court appointment which authorises a person to act and make decisions on behalf of an adult with incapacity. Anyone with an interest can make an application for a guardianship order.
