CAN MINORS ENTER INTO AN AGREEMENT? All parties to a contract must have the legal ability to do so for the agreement to be valid. Minors (who, in California and many other jurisdictions, are under the age of 18) are deemed to lack the mental capacity required to enter into binding agreements under the law.

Contracts signed by minors under the age of 18 do not have the same legal status as contracts signed by adults, as minors do not have the same understanding of the law as adults. The general rule regarding contracting with minors or infants is that such a contract is voidable by the minor. This rule has been established to protect younger individuals who may not fully grasp the consequences of certain contracts. Minors are believed to lack the capacity to contract.

In most cases the age of termination comes later. (The age of majority for signing contracts is 18 in most states, except Alabama and Nebraska, where it is 19, and Indiana, Mississippi, New York and Puerto Rico, where it is 21.

Generally, only individuals with legal capacity can enter into a contract. This means that minors, persons of unsound mind, and persons deprived of civil rights are not capable of contracting. (Civil Code section 1556.)
