The thieves got their hands on Social Security numbers, bank account information, addresses, and more. Capital One got sued for the data breach, and the credit card company has settled the class action lawsuit for $190 million.

The Order and Judgment Granting Final Approval of Class Action Settlement was granted on September 13, 2022. The deadline to file a claim for Lost Time or Out-of-Pocket Losses was September 30, 2022.

Who's Eligible. Settlement Class Members include Bank of America customers who had a checking and/or savings account and were charged one of the following fees between July 1, 2014, and July 29, 2021: retry transaction fee, Intrabank transaction fee, NSF fee, or overdraft fee.

Important Dates. A Settlement has been proposed in a class action lawsuit against Checkers Drive-In Restaurants, Inc. (?Checkers?), arising out of a data security incident that occurred between December 17, 2015 and October 12, 2019, and reported by Checkers on and November 15, 2019.

A 2019 data breach exposed the personal info of more than 100 million Capital One customers. Today is the final day that Capital One customers can claim part of a $190 million settlement stemming from a massive 2019 data breach that exposed more than 100 million people's personal information.

Now anyone who was affected by the breach can file a claim to be reimbursed up to $25,000, up to 15 hours at a rate of at least $25 an hour, and out-of-pocket costs related to the breach, as long as the customer files before the deadline of Sept. 30. Any losses that can be filed on the claim include: Fraud charges.

In order to receive a payment or other benefits from the Capital One data breach settlement, class members must submit a valid claim form by Sept. 30, 2022.

You are a Class Member and eligible to have filed a claim if you received notice of the Settlement. The Notice contained your Unique ID and a PIN required to file a Claim Form.

Update: Bank of America agreed to pay $8 million to end class action claims it hit customers with multiple fees on the same checks in violation of their account agreements.

The Court held a Final Fairness Hearing on January 18, 2022, and granted final approval to the Settlement. How much is the Settlement? BANA has agreed to create a Settlement Fund of $75,000,000.00 (the ?Settlement Fund?).
