The 50/50 crop share lease is one of the oldest leases in agriculture. All income and expenses are split 50/50. The landowner provides the land and the farm operator provides his labor and machinery. Due to the large increase in land values, this lease has become outdated and less common.

Iowa Code § 562.6 generally provides that Iowa leases for a farm tenancy automatically renew for another year under the same terms and conditions as the original lease unless either party provides written termination notice, in the specific manner directed by statute, on or before September 1.

To terminate an oral farm lease, you must provide written notice to your tenant farmer at least four (4) months prior to the end of the lease term. Additionally, your notice must provide specific information as outlined in 735 ILCS 5/9-206.

While each case is unique, for most cases, the tenant must give the landlord written notice and the opportunity to fix the issue. Tenants could face serious financial consequences if they do not follow the proper procedures for ending the lease under the Iowa Code or under the terms of the lease agreement.

If a written agreement is made fixing the time of the termination of a tenancy, the tenancy shall terminate at the time agreed upon, without notice.

The actual tenancy lasts from March 1 to the last day of February the following year. Tenancy notifications must be served prior to September 1st to break any tenancy. For example, if you do not want a tenant on your farm during the 2024 crop season, you must notify them BEFORE September 1, 2023.

562.5 Termination of farm tenancies. In the case of a farm tenancy, the notice must fix the termination of the farm tenancy to take place on the first day of March, except in cases of a mere cropper, whose farm tenancy shall terminate when the crop is harvested.
