Any arbitral award can be challenged in court of law by an appeal filed under section 96 of Civil procedure code, 1908 or it can be declared void or set aside or cancelled under section 34 of Arbitration and Conciliation Act, 1996.

Interim Award ? This is a temporary award until the tribunal has given its final decision. A provisional award can only be made if the parties have agreed that ?the tribunal may have the power to order on a provisional basis any relief which it would have power to grant in a final award? (s. 39 Arbitration Act 1996).

Arbitration is final and binding, subject to review by a court only on a very limited basis. However, a party may file a motion to vacate the arbitration award in a federal or state court of competent jurisdiction pursuant to the Federal Arbitration Act or applicable state statute.

For an arbitral award to be valid it must contain the following essential elements: The award shall be in writing. The award shall be signed by all the members of the arbitral tribunal. The award shall state the reasoning on which it is based. Date and place of arbitration should be mentioned on the award.

There are generally three grounds on which a party may seek to challenge an arbitral award: Substantive grounds: These relate to the substance of an arbitrator's decision: whether the arbitrator committed an error of fact or law (or both) in reaching the decision.

If a party to an arbitration wishes to challenge an award for any reason, they need to make an application to a court except in the rare case where the parties' agreement provides for some type of appellate proceeding within the arbitration.

An award which is set aside is no longer remains enforceable by law. The parties are restored to their former position as to their claims in the dispute. Setting aside an award means that it is rejected as invalid. The award is avoided and the matter becomes open for decision again.

Under California law, arbitration decisions are generally not reviewable for errors of fact or law. There is, though, an exception to this general rule. Courts can vacate arbitration awards if the arbitrator exceeds its powers and the award cannot be corrected without affecting the merits of the decision.
