A traditional writ of mandate is available to challenge an agency's failure to follow its legal obligation or ministerial duty. Unlike administrative mandate, traditional mandate cannot be used to review decisions that result from an adjudicatory process or an administrative hearing.

The petition shall not exceed 50 pages in length and shall contain: (1) the basis for invoking the jurisdiction of the court; (2) the facts on which the petitioner relies; (3) the nature of the relief sought; and (4) argument in support of the petition and appropriate citations of authority.

Pursuant to sub. (5), a certiorari action may be commenced in three ways: 1) under sub. (1) by summons and complaint; 2) by service of an appropriate writ; or 3) by filing a complaint and serving it along with an order, in lieu of a summons, upon the defendant.

A writ of mandamus can be obtained by filing an application for leave and judicial review at the Federal Court of Canada. There are strict requirements as it relates to the documents, filing and service of another party. Due to the complexity, it is highly recommended to retain the services of an immigration lawyer.

Mandamus is a civil action. The writ of mandamus shall specify the time within which the defendant shall make return thereto. Before such time expires the defendant may move to quash the writ and such motion shall be deemed a motion to dismiss the complaint under s. 802.06 (2).
