Wisconsin Order for Reimbursement of Costs of Legal Services (Chapter 51), is a state law that requires that a court order the reimbursement of court costs and attorney's fees for individuals who prevail in a civil action, or special proceeding. The law applies to all courts in the state, including Circuit Courts, Municipal Courts, and the Wisconsin Supreme Court. The law allows a court to order reimbursement of costs and fees for either party in a civil action, or special proceeding, that either party may have incurred in preparation or trial of the action. The law applies to all cases, regardless of whether the action is brought by the plaintiff or defendant. There are two types of orders for reimbursement of costs and fees under Chapter 51: the Order for Reimbursement of Costs and Fees, and the Order for Reimbursement of Attorney's Fees. The Order for Reimbursement of Costs and Fees is a court order that requires a party to pay the other side's costs and fees associated with the case, including court filing fees, witness fees, deposition costs, expert witness fees, and other related costs. The Order for Reimbursement of Attorney's Fees is a court order that requires a party to pay the other side's attorney's fees, including fees for legal services rendered during the course of the case. The Order for Reimbursement of Costs and Fees and the Order for Reimbursement of Attorney's Fees are both subject to the court's discretion and must be reasonable and necessary to the case.
