Utah Noneconomic Damages are defined as any losses an individual may suffer which do not have a tangible monetary value. This may include pain and suffering, emotional distress, loss of consortium or companionship, humiliation, mental anguish, or any other non-pecuniary losses. These damages are intended to compensate an individual for the psychological impact a personal injury or wrongful death has had on them. The two main types of Utah Noneconomic Damages are Compensatory Damages and Punitive Damages. Compensatory Damages seek to reimburse a person for the losses suffered as a result of the injury or death. This amount is determined by the court based on the facts presented, and is meant to make the injured party whole. Punitive Damages are awarded in cases where the defendant’s actions were considered particularly egregious and require additional punishment. These damages are intended to deter similar behavior in the future, and are usually quite substantial.
